'Love Potion No. 9' singer sues over Clovers' name

WASHINGTON (AP) ? Harold Winley sang "Love Potion No. 9" and other hits with the R&B group The Clovers in the 1950s, but now the 80-year-old says another group is trying to keep him from performing using the band's name.

Winley says he was in his teens when he and four other singers started performing as The Clovers in the Washington area. The R&B group played at New York's Apollo Theater, eventually signed with Atlantic Records and celebrated when "Love Potion No. 9" became their biggest hit in 1959.

"It was great," said Winley, who now lives in Lauderdale Lakes, Fla. "We didn't make no money but we had a lot of fun."

The group's success fell off in the 1960s, however. And that's when things got more complicated, leading to a lawsuit filed earlier this year in federal court in Washington.

Winley and another band mate, Harold Lucas, went on to perform with separate musical groups that called themselves The Clovers, and Harold Lucas' group eventually trademarked the name in the 1980s. Lucas died in 1994, but two of the men he trademarked the group's name with continue to use it when performing.

Winley says the group has threatened venues who have booked him when he's used The Clovers' name, forcing organizers to cancel his shows at least twice. That's why he filed his lawsuit.

"It is our position that when people come to see The Clovers they expect that they are going to see Harold Winley or another original member of The Clovers," said Winley's lawyer, Brad Newberg.

Winley says his bass voice is still strong and he'd like to perform as much as possible. But if he goes on stage, he said, "I want to go on stage as The Clovers." He recently tried filing a trademark application for "The Original Clovers featuring Harold Winley" but was denied.

A lawyer representing the two men who hold The Clovers trademark did not return several telephone calls and an e-mail requesting comment. The attorney previously filed a court document asking that the lawsuit be dismissed.

The song "Love Potion No. 9" was written and composed by Mike Stoller and Jerry Leiber, the duo behind many of Elvis Presley's biggest hits. The lighthearted song is about a man looking for love who visits a gypsy, who says "what you need is Love Potion Number Nine." He starts "kissing everything in sight" until he kisses a police officer, who the singer explains "broke my little bottle of Love Potion Number Nine."

After The Clovers' version rocketed up the charts in 1959, the song was covered by various groups and singers, most notably England's The Searchers, who had a hit version of it a few years later. The Clovers' version was later featured in George Lucas' iconic 1973 film "American Graffiti." It was later the title of a 1992 Sandra Bullock romantic comedy.

Charles Stevens, one of the group members from Lucas' Clovers, called the lawsuit "frivolous." Stevens, who lives in Washington, said Winley is not an "original Clover" because he didn't start with the group until the late 1940s. Lucas and three others were performing as the Four Clovers before Winley joined.

"All of a sudden he wants to come back and be The Clovers again," Stevens said, adding that his group has had the trademark for decades and now performs two or three times a year.

He says he doesn't mind if Winley uses the name "The Clovers," but he has a problem with the word "original." Stevens says his group had a former agent who may have called venues that booked Winley, but Stevens says he never personally blocked Winley from booking shows.

Both sides have agreed to mediation and will meet Monday to see if they can work things out.

Said Stevens: "We really do want to get this behind us."

Bangkok braces for political street protests

BANGKOK (AP) ? Thailand's capital braced Sunday for possible unrest in the week ahead, with street protests expected over moves in parliament that could eventually lead to a pardon for ousted Prime Minister Thaksin Shinawatra.

By late Sunday afternoon, as many as 2,000 protesters calling themselves the People's Army Against the Thaksin Regime had turned up for a peaceful rally in a Bangkok park. But bigger and more militant protests are expected when parliament on Wednesday begins debating an amnesty bill that would cover people arrested for political activities since the 2006 military coup that ousted Thaksin for alleged corruption and disrespect to the monarchy.

Thaksin was later sentenced to two years in jail on a conflict of interest charge, but escaped punishment by living abroad in self-imposed exile. The amnesty bill would not cover Thaksin, but his opponents fear that if it passes, it would set a precedent and pave the way for another measure pardoning him. The bill was proposed by a lawmaker from the ruling Pheu Thai Party, which is headed by Thaksin's sister, Prime Minister Yingluck Shinawatra.

The unease caused by the specter of protests reflects Thailand's failure to achieve political reconciliation after the coup, with Thaksin's supporters and opponents battling for power since his ouster. In 2010, about 90 people were killed when Thaksin's supporters occupied part of downtown Bangkok for around two months before being swept away by the army. In 2008, Thaksin's opponents occupied the prime minister's offices for about three months and Bangkok's two airports for a week.

Thaksin is a highly polarizing figure who won large majorities in winning office, especially from rural voters who gained from his populist policies. Critics accused him of corruption and abuse of power, charging he was imposing a "parliamentary dictatorship" and trying to usurp King Bhumibol Adulyadej's constitutional authority.

Even though Thaksin's political allies currently lead the government, they have not been able to push through measures allowing for his free return, thanks largely to opposition by royalists and the military.

While it is not clear how many protesters the opposition can muster, Yingluck's government is taking few chances.

This past week, it invoked the Internal Security Act in three Bangkok districts, citing the possibility of protest violence, and readied more than 30,000 police officers to provide safety at key locations, including the prime minister's office compound and parliament.

The act, in effect from Aug. 1-10, authorizes officials to seal off roads, take action against security threats, impose curfews and ban the use of electronic devices in designated areas. Peaceful and unarmed rallies are allowed under the law.

"We will take care of the protesters and will make sure ordinary people can commute and carry on their daily lives," Yingluck said during her weekly television talk show, aired Saturday morning. "I hope under these circumstances, we can get through the situation smoothly."

Sunday's protest, held in a part of Bangkok far from government offices, was low-key. The so-called People's Army is a fringe group, nominally led by former senior military officers with close ties to the country's royalist establishment. It has little of the organizing skill or appeal of the People's Alliance for Democracy, which led large-scale and effective anti-Thaksin protests before the coup in 2006, and again in 2008, when another pro-Thaksin government was in power. The alliance has not committed itself to taking part in the current round of protests.

One of the People's Army co-leaders, Banawit Kengrian, said Sunday that his protesters would stay overnight and remain as long as needed, adding that he wanted matters to end in seven days.

"Our goal is to unroot the so-called Thaksin regime from our country," he told reporters. "We do not aim to topple the government, but we cannot let them push for the bill by ignoring people's opinions and passing it with the parliamentary dictatorship they have."

Banawit would not say what the next move would be, saying he was afraid the protesters would be blocked by the government, and refused to comment on whether his group would march to parliament. He said, however, that the group had a strategy and would announce its plans 12 hours ahead of time.

OH attorney general warns of military scams

COLUMBUS, Ohio (AP) -- Ohio's attorney general has warned members of the U.S. military and their families to be alert to consumer scams including some specifically targeting military personnel.

Attorney General Mike DeWine says some of the military-specific scams include targeting grandparents of military personnel. The scammers claim the consumer's grandchild in the military has been arrested and detained overseas and the grandparents must wire money.

Other scams involve family members of deployed service members being asked to send money so the service members can go on early leave.

DeWine encourages active-duty military members and their families to report any consumer complaints to his office. DeWine says his office offers a fast-track complaint process and some free legal services to military personnel.

Despite arsonist, LaFollette church starts anew

(WBIR-LaFollette) Members of a Campbell County church are ready for a new chapter, after a fire destroyed their church in December.

Investigators ruled the fire as arson.

More than seven months later, Fincastle Church of God will hold a dedication service in its new building on Saturday.

"It's a joy, joy to see it because there has been so much work put into it," Fincastle Church of God Pastor Mike Smith said.

The church is 20 ft. longer and 20 ft. wider than its previous building. It's also able to seat 235 people in the sanctuary, versus the 150 from before.

A surviving Bible and table from the fire will be on display in the foyer.

"There's a lot of stuff that was burned up besides the building, a lot of memories, a lot of stuff we had that can never be replaced. And now we're putting new stuff in and we're starting new," Pastor Smith said.

The church had been using the Fellowship Hall for services.

"We've actually gotten closer together and we haven't lost anyone through all this tragedy," said Bill Vance, a church member.

On Wednesday, John Scates with J.S. Audio put the finishing touches to the new sound system.

"Several days I've been here. There's always people coming through, church members and community members. They want to see how everything is progressing and it is very exciting," Scates said.

Fincastle Church of God will hold a dedication service, open to the public, at the church on Saturday at 5 p.m.

Pastor Smith said insurance covered $260,000 worth of damages; the church still owes the bank $170,000. Donations can be made to the church through First Community Trust Bank in LaFollette.

Report: Antawn Jamison to meet with Clippers head coach Doc Rivers

We?re at that time in the NBA offseason where there isn?t much going on, so any small bit of news of a free agent inching closer to deciding on a new destination becomes an element of interest.

The mini-frenzy created by Greg Oden?s signing with the Heat on Friday qualifies, considering he hasn?t played in the NBA the last three years and is still, even by his own account, a substantial ways away from contributing at the NBA level.

The interest surrounding Antawn Jamison isn?t nearly as strong, but with the list of contending teams he?s considering, he may be able to impact a playoff run, even at this late stage of his career.

The Clippers, as they did near the beginning of free agency, seem to be interested in Jamison?s services.

Marc Spears of Yahoo! Sports reported that Doc Rivers is scheduled to have dinner with Jamison on Saturday ? presumably at an establishment with a slightly stronger menu selection than the Chili?s where Oden supposedly had dinner with Erik Spoelstra.

Jamison can still score, but defensively he is a liability, and that?s putting it mildly. But another veteran at the end of the bench for a team as deep as the Clippers can?t hurt, and if Rivers wants Jamison in place, he shouldn?t have much trouble convincing him to switch teams in Los Angeles.

    TCA: 'Sons of Anarchy' premiere will genuinely shock people

    NEW YORK (TheWrap.com) - "Sons of Anarchy" returns with a Season 6 premiere next month that is going to shock people. We won't say what it is, but will say this: We're very surprised the show goes where it goes.

    Speaking at a Television Critics Association panel Friday, creator Kurt Sutter said he talked with FX CEO John Landgraf about the storyline, which draws from hotly debated recent events. (And that's all the description we'll give.) Landgraf is know for giving his showrunners more creative freedom than they would likely get elsewhere.

    "This is a story that I've wanted to do for a while and although it's controversial I wasn't not going to tell it because of that," he told TheWrap.

    Sutter is known for pushing boundaries - have you read his @sutterink tweets? - and the storyline in the September 10 episode promises to go further than ever.

    "This is a story that is not being done to be sensational. I'm hoping that it's not spoiled and it's not leaked out in any capacity before the premiere, and that it is truly the catalyst for the final act of our morality play," Sutter said.

    So don't Google SOA spoilers, okay? Sutter will tell the story better than that grumpy blogger can, and September 10 is just over a month away.

    Apple offers Color Zen for free through Apple Store app

    The Apple Store app for iPhone has added a free content offer as previous reports indicated that it would, letting app users download the game Color Zen for free.

    To download the app, open the Apple Store app and select the Stores tab. Once you've picked the store closest to you, you'll see the game offer at the top of the list, just below the store's information. Selecting the game will take you to a page, where you'll hit a button to be taken to the App Store to redeem the offer.

    This is likely to be the first of several such offerings. It's unknown at this time if Apple will offer media like music, movies, or TV episodes, or stick with apps. Apple is planning a big retail push, and getting customers to use the Apple Store app is part of that push.     Stocks open slightly lower after disappointing jobs data

    Stocks closed modestly higher in thin volume on Friday despite a tepid jobs report. While the data was disappointing, it still showed job growth and may also make the Federal Reserve a bit more hesitant about curtailing its stimulus policies in September.

    The U.S. economy created just 162,000 nonfarm payroll jobs in July after a downwardly revised 188,000 in June. The unemployment rate fell to 7.4 percent.

    The quality of the jobs being created is also an issue. Burt White of LPL Financial pointed out, "Over the last four months we've created 4.2 part-time jobs for every one full-time job. That trend is not going in a good direction."

    After spending the session clawing back morning losses, the Dow Jones Industrial Average?finished 30 points higher at 15,658.36. The?S&P 500 and Nasdaq ended with slight gains, while both the S&P and Dow set new closing highs.

    The CBOE Volatility Index (VIX), widely considered the best gauge of fear in the market, fell to 12.1.

    Among S&P sectors, consumer discretionary and materials stocks led the gainers. Energy fell after disappointing earnings from oil giant Chevron.

    "I think the market grinds higher," Bob Doll, chief equity strategist at Nuveen Asset Management, said. "We're not going to go up another 18 percent as we have since the first of the year in my opinion. But I think the market ends higher than where it is today."

    The jobs data may push back the timing, or at least scale, of a potential Fed tapering of its bond-buying program.

    St. Louis Fed president James Bullard said in a speech Friday that the central bank "needs to see more data" before it makes a decision about slowing the pace of its $85 billion-a-month bond-buying program.

    Some economists, meanwhile, see just a small reduction in bond purchases next month.

    "I think they'll only do $15 billion because the evidence will be still somewhat ambiguous," BNY Mellon economist Richard Hoey told CNBC of the potential cutback in bond purchases. "I don't think they'll do $25 billion. That's too strong a measure."

    In other data, U.S. consumer spending increased 0.5 percent in June, lifted by automobile purchases and higher gasoline prices. Personal incomes rose 0.3 percent. June factory orders, meanwhile, rose 1.5 percent after an upwardly revised 3 percent in May.

    Cable stocks rose on reports that Cox Communications and Charter Communications held merger talks. Cablevision was up sharply as well.

    Viacom, meanwhile, reported a 14 percent rise in revenue helped by strong advertising and CBS affiliate fees at its cable networks. The media giant also doubled its stock buyback program to $20 billion.

    LinkedIn shares surged following better-than-expected earnings and after a number of brokers hiked their price targets on the social networking firm.

    AIG stock rose after the company posted strong earnings and said it would return capital to shareholders.

    But oil giant?Chevron posted a 26 percent decline in net income?due to lower oil prices and maintenance work at its U.S. refineries.

    Port Moody mayor to open youth arts festival on Friday

    Dance, music, visual art and film will be featured by Tri-City teens this week at the second annual Port Moody Youth Arts Festival.

    The two-day event ? held as part of the city?s centennial celebrations ? is being organized by the Port Moody Arts Centre society board members Hilary Letwin and Fitnat Fahrner, with the help of Susan Ius who was involved in the inaugural gala last year. Letwin said they tried to offer a varied program to attract a larger audience and ?I think it?s going to be a really good showcase in terms of the different groups out there in our community,? she said.

    For the two dozen or so participants, aged 13 to 18, the festival will be a good platform to promote their talent, to make connections with their peers and to build their resumes. ?It?s really empowering for them,? Letwin said.

    And for kids in the crowd, ?This is a good opportunity for them to see what teenagers are doing in the arts and in a professional setting. They can really learn from them.?

    Working on a shoestring budget, the organizers have had help from the city, corporate sponsors ? including The Tri-City News ? and volunteers to get the event off the ground. There will be plenty of goodies handed out such as door prizes and iPads. As well, on Friday when Mayor Mike Clay opens the festivities, Rocky Point Ice Cream is donating $1 from the sale of each cone to the festival for its operations.

    ? The Port Moody Youth Arts Festival runs Friday and Saturday from 6 to 10 p.m. at Port Moody city hall. Admission is by donation.

    Shen shares her passion for the arts

    While Port Moody secondary student Lucy Shen will be on stage on Friday, she won?t have any song or dance routine to entertain the audience.

    Instead, Shen will use her background as a public speaker to introduce the performers.

    Being picked to emcee ?is really cool,? she said, ?because I really love the arts and I think that it?s important for young people to have an opportunity to display their talent in a public forum,? she said.

    Besides the arts, the Grade 12 student is also passionate about social justice causes. In March, with her PMSS friends, she founded Dare to Dream, a club that promotes gender equality around the world.

    In three months, it raised $400 for the Vancouver Women?s Shelter at a film festival.

    And next year, she hopes to collect money for a local cause: the Tri-Cities? Transition Centre that helps women and children flee abuse.

    Ska-funk is in their blood

    Three years ago, while playing in their middle school concert band, drummer Eric Bates and bassist Mac Halvorsen founded ADOB.

    They soon recruited Theoren Nesbitt for guitar and, a little while later, Francis Henson was brought in for vocals and guitar.

    The band was just for fun until they clinched the top prize in a provincial-wide contest for youth bands last year.

    ?After that we thought, ?We should keep doing this,?? Henson said.

    Since then, the Grade 11 students have been staple performers at their school ? Port Moody secondary ? and jamming every chance they can get.

    ?We like to perform. It?s one of our strengths as a band. We?re just four friends who like to play together,? Henson said.

    The foursome write original ska-funk songs but also like to keep their sets current with covers.

    They will open Saturday?s line-up with a 30-minute program, ?keeping it as lively and fun and entertaining as possible,? Henson said.

    And he hopes the festival audience ?will find us on the internet and join our fan base. We also hope to talk to them afterwards and get to know us better.?

    Four pieces on show

    Shawna Lee was in Grade 4 when she first saw a gallery of children?s art by Tri-City art teacher Evelia Espinosa.

    ?I thought, ?Wow, if they can do it then so can I,?? said the 15-year-old Coquitlam resident.

    Over the years, she plied her craft and is now being taught privately by painter Melanie Cossey as well as at her school, Archbishop Carney regional secondary in Port Coquitlam, under the direction of Linda Reis.

    Lee primarily works with acrylics and oils and, for the Port Moody Youth Arts Festival, she will have four pieces on display in the city hall Galleria: an 18-by-24-inch oil reproduction of Hunter Bonyun?s Matter of Time; two acrylic works; and eight slides done pencil crayon, depicting the stages of strawberries being eaten.

    Lee said she decided to apply to the festival after one of her friends played music at the event last year.

    ?I thought, ?Why not? I can do it, too. It?s a great way to get young artists known in the community and to showcase what I?ve been working on for the past couple of years,?? she said.

    Student songbird

    ?Music has always been really important for me,? Julia Montgomery starts.

    ?It?s one of the biggest driving forces behind everything I do so whenever I get an opportunity to share it with the world, I want to jump on that because I think it?s really important.?

    Now 15, Montgomery said she started vocal lessons when she was in Grade 6 ?after my parents finally wore down and let me take them,? she said with a laugh.

    But while she has been studying musical theatre privately at the Lindbjerg Academy of Performing Arts in Coquitlam, under Elaine Lindbjerg, Montgomery has also been penning alternative tunes of her own.

    Her 15-minute set on the Inlet Theatre stage on Friday night will be a combination of pop, musical theatre and her original songs.

    Montgomery said she?s grateful for the festival committee for providing ?a deeper appreciation for the arts and all the talent that?s in Port Moody ? especially from the younger people.?

    Cultural shakers

    This will be Lia Fallah?s second time performing at the Port Moody Youth Arts Festival but the first time with a group.

    Last year, the Gleneagle secondary student did a solo number that wowed the crowds. ?I enjoyed it so much,? the Grade 12 student said. ?Of course, I wanted to come back!?

    For this year?s set, Fallah will be joined by her friends Gabrielle Stocker and Courtney Baines who will dance a wedding celebration to an Iranian groove.

    Fallah, who portrays the bride, choreographed the number with her mother and stitched the costumes.

    She is a little nervous that Anahita will close the festival on Saturday but is also excited at the opportunity.

    As for their next steps, Anahita will learn Irish and Scottish jigs. ?We want to know the techniques and styles of all the cultural dances, all over the world,? Fallah said.

    Who knew children's musical instruments could be employed to make the summer's No. 1 hit sound ... well, even better? Jimmy Fallon, that's who. And when Robin Thicke passed through New York recently, Fallon pulled aside his "Late Night" house band The Roots and those now-familiar instruments for a duet of "Blurred Lines."
